Wife left before our child is born

She left the short marrage before our child is born and is out of state. Do I have any rights for custody/visitation after the child is born?

You will probably need to bring the custody action in the state where the child is born, since, in my opinion, the State of California does not have jurisdiction over the issue of custody. Good Luck, Pat McCrary

Of course you have rights if you are the father. If you are not planning on divorcing then visitation/custody may be worked out between the two of you. However, it sounds like you may be contemplating divorce if she has left the state with child and without you! You may wish to start the marital dissolution process where custody and visitation of the child can be addressed. Feel free to contact my office.
