Legal Question in Family Law in California

My ex wife left me in May 2009. She has never returned to reside in the house we had together since she left. The divorce has been finalized for quite some time now. The rights to the house were never confirmed in the divorce. I still reside in the house with my new wife. Does my ex wife still have any right to move back into the house?

Unless you have a court order awarding you exclusive use and control of the house, she could press the issue. Best to clean up your affairs and return to court on a motion to properly finish dividing the house.

I agree with Ms. Kock. The family court retains jurisdiction to confirm or divide assets that were not taken care of in the divorce.
