Legal Question in Family Law in California

My wife and I are married for 16 years. I have supported all since day one and I still am. However, when she started working she opened her own bank account and since refuses to pay part of the bills. We have a house and many loans.

Each time I ask her to help, she starts yelling at me (verbal abuse).This is affecting my health as it triggers my Meniere disease and I start having vertigo.

Furthermore, my children are asking me for money to go eat out, participate in a sport event etc...I just keep telling them that I don't have any money.

At this point I am wondering if I just have to file for divorce or sue her in court to get her to pay her part of the bill or at least to give a breather to stop borrowing money so she can save hers.

Please help.

We can't tell you whether or not to get a divorce. That is a marriage counselor question, not a legal one. All I can tell you is if you divorce her, half the money she has saved from work during the marriage would be yours, and half the debts would be hers, unless there are details and circumstances you have not shared with us.

You have a choice to live with the current situation or to file for a dissolution. If you file for a dissolution then she will be responsible for half of the debt, as well as half of the equity in any asset, such as your home. You may also be responsible for spousal support depending upon how your earnings compare to hers. Start with a marriage counselor or your pastor.
