Legal Question in Family Law in California

My wife is from Michigan, and I am from France but we got legally married in California 5 years ago. We want to divorce and have a 10 month old son. We don't argue on anything , what would be the 'ideal' solution for our kid? getting the paper work done in CA or in MI?

Thanks for your help

Sebastien

First off, unless one of you has lived in MI for the last six months, MI does not have jurisdiction over any divorce proceedings. Where you are from does not matter. Where the parties have resided for the most recent six months is what counts. IF both CA and MI have colorable jurisdiction, there is no way to say what would be the ideal situation for the child without knowing all the facts and circumstances of your family, your finances, and you and your wife's intentions and wishes for the child.
