My ex wife is ordered to pay child support and has filed a Request for Hearing Regarding Earnings Assignment

She did not serve me yet but since its only a wage assignment hearing do i need to be present? what happens if I dont show up?

This cannot change the amount of the support only the amount they garnish correct?

Wage assignments for support payments are very difficult to oppose. In California, there is a right to the wage assignment, against the party who is ordered to pay support.

I suggest that you show up to the hearing, so that you can answer any of the judge's questions. Also, be sure to file a response to the papers, when you are served. Otherwise, the court will only hear one side of the story.

The hearing on the wage assignment will not change the amount of the support, although you should read the papers carefully because the hearing may be on, both, the wage assignment and a modification of the support.
