I've never understood how people can be "separated" - but living together. It doesn't really make sense.

I assume that you are not legally separated, meaning that you have not filed any paperwork with the court to commence a legal separation, and obtain custody and visitation orders. You are going to have to decide whether to be divorced or legally separated. I strongly suggest you speak to a family law attorney.

If you have already filed for legal separation, you are going to have to get orders in place for custody and visitation in the existing case as pointed out by Mr. Shen.

It is going to be difficult to have her served if you don't know where she is at.
