Legal Question in Family Law in California
My wife and I separated in November and she agreed to pay the house loan until the divorce. Now she is 3 months behind on payments and bank is talking about default. What agreement/form can I use to release her interest into the loan (married for over 10 yrs) and take over payments. I don't want to get her caught up only to lose the house again during the divorce.

You need to get the divorce on file and get emergency temporary orders in place for handling this. You can't really accomplish what you want just by writing up some form. If the divorce is already on file, then you need to make an ex parte application for temporary orders for payment and occupancy of the house.
