The children have a right to have an ongoing uninterrupted relationship with their father. When you file and serve your divorce action include with that a motion to establish the parenting relationship.

Ms. Kock is right. Your rights are to file for divorce and file an ex parte motion to establish a custody and visitation schedule order. Also, your wife refusing to let you see the kids is a factor in favor of you getting primary custody if you want it. Not a guarantee, but it is a factor the court considers.
