Legal Question in Family Law in California

My wife and I have been talking about divorcing for the past two months. We are close to an agreement, however new business opportunities have presented themselves and I would like to know if there is any way I can create a new corporation or LLC before filing for divorce without my wife claiming any right about it.

Nope. And she may be able to claim an interest in it even after you separate. If you ant to keep this amicable, you should hire a family law mediator to guide you through a fair arrangement. You don't actually have to give her an interest in the new business even though she would have a right to it. All it really means is the value of the opportunity has to be figured into the distribution of assets and debts.
