Legal Question in Family Law in California
My wife and I are on the verge of divorce. She said she would leave about a week ago and I booked her a reservation to go but she backed out at the last minute. Now, she has become extremely vindictive and troublesome. She will leave the water running in the sink and leave electrical appliances running all to jack up the bills (which are in her name though I have always paid them). She even recently pulled the batteries out of all the house phones because I called her mom for help with her. She has started to smoke in our bedroom and is stinking the room and house up. She is making life around the house unbearable, expecially for my 18-year old step-daughter who she is constantly accusing of sleeping with me and calls a slut and a whore. If this continues, it will be hard to just pay the rent for the house. Is there anything I can do to get her out? Both of our names are on the lease unfortunately, but she is hell-bent on getting us evicted. How can I stop her?

The only two things you can do are move out yourself, or file for divorce with an emergency application for sole possession of the family residence. There is no guarantee you will get it, but it's the only option.
