Does new wife's income count...
My ex wife is taking me back to court to try to modify child support. The last time it was modified, I was not married to my current wife yet. Now that I am, they want to know all of my current wife's income and expenses. Can they use her income to determine a new child support amount or do they only use my income to determine that. I know that they consider my new wife's income and expenses to determine the offset of my expenses, but I need to know if they consider her salary.

Your new spouse's income may possibly lower your child support. I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

Under the current child support law only your income is used to compute child support. The only use of your wife's income would be to determine the amount of income taxes you actually pay. Often the addition of the new spouse income to the income tax picture will reduce the amount of child support, as the taxes go up.
