Legal Question in Family Law in California
Will I have to pay child support for my fiances children?
I just became engaged, my fiance has three children from his prior marriage. We just bought our first home and we have an eight month old baby. If I were to marry him will my income be considered in his child support, therefore increasing it? Will I have to pay for his child support? And finally will his x-wife ever be able to put a lien on our home?

You won't have to pay his child support obligation. That is an order against him. But, understand half of your earnings once you become married are his. Further, any property that he owns, with or without you, may be subject to enforcement of child support obligations. Prior to your marriage, you should consult with a local family law attorney and asset management firm to give you the best options for your future together. Good luck and thanks for inquiring.

Your income will be considered to the extent it changes the actual amount of income tax he pays. New spouse income sometimes reduces the amount of child support. Any property which he has an interest in can be attached for child support. Thus a joint bank account, house held in either joint tenancy or as community property. A checking account in your name alone would not normally be attached to pay for his child support. You should confer with a family law attorney and learn how you can best protect your property from attachment.

You will not be required to pay his child support obligation, and your income may possibly lower his suport obligation.
