Legal Question in Family Law in California

What is the best will for my situation

I am a single mother with 2 children and a live in partner.

In the event of my death, I want my partner to be allowed to live at the/my property until he dies and then for the property to be turned over to my children. So I need to know which will is best for this situation?

Re: What is the best will for my situation

from the facts given, you should have an attorney draft a will and/or trust which will effectuate your testamentary intent. you appear to want to devise a life estate in this property for your live-in partner and then a vested remainder future interest (class gift) to all of your children thereafter. this can easily be drafted, as well as anything else you might want to have included. if you would like further assistance and/or a will or trust drafted as per your instructions, feel free to email my Law Firm directly and we could have such instruments in place for you asap. warmest regards.

It is difficult to provide you with an answer given the limited information you have provided. You may want to use a "life estate" to accomplish your purpose.

I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

You will find some valuable information at my web site.

Good luck to you!
