Willfull non-payment of child support arrears
My ex owes approx. $70,000 in back child support. He was on disability for a few years with a pending lawsuit related to a work injury. He settled the suit in excess of $100,000, yet never made support payments and continues not to make payments. He is currently self-employed making collection very difficult. I am attempting to pursue criminal charges through the DA. Since he had the ability to pay, via the settlement, can this be considered income?
