If I have a will stating that I want my son to stay in the care of my Husband, his step father, if something was to happen to me. Could My sons Paternal father fight my husband for Custody.

Your sons biological parent does have rights to your child unless he relinquishes those rights. Your best option may be a full adoption by your new husband.
