Legal Question in Family Law in California

Witch Custody Order Will Provail

On June 15 1998 there was a los angeles county juvenile custody order and a family law order signed and filed ,june 15 1998 at least thats what the june 1998 minute order states. On july 30 2003 orange county family law court issues a custody order only and finds that their court has jurisdiction.ON August 17 2003 I found out that the los angeles county juvenile dependency court forgot or made a mistake and NEVER DID file the family law order as stated in the june 1998 minute order. The family law order was finally filed August 29 2003 downtown los angeles family law court makeing it the most current filing.Which CUSTODY ORDER takes PRESENCDENCE?

Re: Witch Custody Order Will Provail

The juvenile court was the earlier in time, even though it was not put in the form of an order and filed at that time. The family court order is the last order in time issued by a court with jurisdiction, and it is therefore the present order. It superecedes the juvenile court order.

The above response is based on the facts that you provided. You really need to take both orders to an attorney for review and determination of which order pakes precedence.
