woman in California with 3 yr old child - not married to the father - she has physical custody -he does not pay child support at this time. She wants to move to Ohio with her child to marry her boyfriend. Does she need to have legal assistance for this? She is worried they would charge her with kidnapping her own child.

Leaving without a court order specifying your right to move the child can create the risk of you receiving court orders mandating the child's to return to the home state of California.
