Legal Question in Family Law in California

I was wondering if I could terminate my grandparents as legal guardians of my 15 year old brother and give guardianship to either myself or a family that adopted my sister that live in Washington. We currently live in California. Here is my situation: I am 19 years old. My mom signed over guardianship to my grandparents of both of us in 2001. At the time, it was for the best. Now both my grandparents are disabled and unemployed. They do not have a substantial income to provide for my brother, nor can they pay the bills. My brother wants to move, the family has an adequate income and a room for him. My mom agrees it is for the best, but my grandparents do not have my brothers best interests in heart by making him stay here.

You could file a motion to change guardian for your brother. If the only problem with him residing with the grandparents is a lack of money, the court could solve that problem by ordering the mother and father to pay child support. The grandparents could also request AFDC payments for him. This option should be checked before taking action to change the guardian.
