Legal Question in Family Law in California

written agreement not notarized

We have a typed written agrrement between us with our signatures along with our neighbors signature (it is also dated). As things have changed drastically since this was written out 7/04, is it binding in California if it was not notarized at the time we signed it? We are still married legally but live apart.

Written agreements are as a general rule enforceable. However, in a agreement between spouses generally are limited if there is overreaching or undue influence by one spouse. Also a change of circumstances can result in the agreement being modified. However, you have not provided enough information to state an opinion as to whether your agreement is valid, or can be modified.
