Legal Question in Family Law in California

Wrong doing?

In 2001, my ex-husband went into my apartment removing a photograph to copy to take it to his attorney, to get me in contempt of court. In the police report, he admitted that he wasn't supposed to enter my residence nor was he to remove anything from my residence. He did, like I said removed a photograpgh. In the police report, he was told by my son not to remove anything but he did. The police officer told him to bring it back or to be charged with theft. He eventually gave the photograph back but kept the copy to submit into court. In court he committed perjury on how he received the photograph. He then took my child custody down from 49% down to 20%. Whenever I go into mediation all she does is viciously and verbally attacks me. The last time that I went she asked me if I were ever tested in school for being retarted. She asked me that because I didn't agree with what she was wanting me to agree with. She believes all my ex-husnabds lies and then submits them to court. I was told by an attorney that the mediator hates me and that the mediator works for the judge. Even though I was divorced in Tehama County how can I get my case transfered to Sacramento County. My ex has been in violation of the court order numerious times.

Re: Wrong doing?

Getting the court to order a change of venue would be difficult, based on the facts you cited. The judge apparently does not believe your statements that the mediator is biased against you. Your best approach may be to retain a local attorney to assist you in convincing the court that the mediator is biased against you. Cases such as you describe occur all to often and are tragic because they skew the results and often harm the children.
