Legal Question in Family Law in California
Wrongly Founded CPS Case
I was in a heated custody battle with a vindictive ex-girlfriend who wanted to get out of paying child support. I had custody of the children for 5 years and she came back and wanted custody of them to rid herself of back child support. When I refused to just give over the kids, I was turned into an abusive person and she contacted every agency known to man with letters and other fabrications. I was eventually charged with child abuse. I was advised by my paid attorney to take plea and do a prenting class because he said he couldn't garuantee a win due to unpredictable juries, and he would have to really go after my children on the stand. My life's work is dealing with children and I have a CPS file hanging over my head that is not valid. The criminal case was eventually dismissed, but the CPS stuff is on my name. How do I get it off. I have evidence to support my case.

We deeply empathize with the set of unfortunate circumstances you were seemingly needlessly put thru based on the conduct of your ex, however, we are very happy to hear that the criminal charges were dismissed. As far as the existing CPS issues are concerned, if you have the substantive evidence to effectively rebut the claims against you, you should promptly move forward in this civil matter.
