Legal Question in Family Law in California
X-Husbands pension
I have been divorced now for 14 yrs. in my divorce papers it states I am entitled to part (not specified) of my husbands pension plan at the time of retirement. I hav just recently found out he started collecting on this about 1 yr. ago. My Attorney at the , he is now retired, so I do not have any legal advice. I am almost 67 yrs. old and am still employed. My question is what do I have to do to get my portion of his pension? I really can't afford an Attorney. please help me with this I already know he (husband) will not on his own share his pension with me. HELP ! How do I collect. THANKS

Re: X-Husbands pension
You did not indicate whether or not the pension is private or govt. It is likely that you will need a Qualified Domestic Relations Order (QDRO). This is not the same as your divorce judgment. It is very unlikely that you will be able to enforce your rights without an attorney. There are some firms that specialize in preparation of QDROs. One is called QDRO Pro. I suggest you meet with an attorney. He or she might be willing to take the matter with a minimal retainer and seek a contribution from your ex for the balance. Don't wait.
