Legal Question in Family Law in California
It has been nine years since I have legally seperated
Ihave been legally seperated for over nine years. I have not seen or heard from him at all. We have a nine year old that I have full sole and physical custody for. He has not been in contact with us for over a little over nine years. (My son will be ten in October). I never collected child support, which I really don't care to collect. I want to be legally divorved now but I don't want to be in contact with him at all. Since it has such a long time what do I do now?

To obtain a divorce you will have to give him notice. You will have to exercise "due dilligence" to find him. If the court is convinced that you did everything reasonable, but still could not locate him, they may allow you to serve notice by publication. Good luck.

We will have to do a skip-trace, and serve by publication if his address is unknown. You will not need to appear at court in this case. Contact me directly.
