Legal Question in Family Law in California

Can Yolo county take money out of income taxes when married filing jointly if I did not work during the 2010 tax year? The child support obligation is mine not my husband's.

A tax intercept is a legal way for the DCSS to collect on balance due of child support. You are allowed to file a motion with the court to have a hearing to determine whether the intercept is legal or not. You may have an argument if you can prove that the funds from the tax return are based upon your income alone. You will need to prove that however.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
