Legal Question in Medical Leave in California

Family Leave Specifics

Hi,

I am researching this for my mother, who has recently taken a stress leave after my grandmother suffered a severe stroke. She is worried that the hmo is challenging her paid stress leave and wants to be able to take family unpaid leave if they do deem her paid leave unworthy.

Basically my question is this: Does family leave pertain to the time when someone as sick AS WELL AS after they have passed? There will be much to be done after she passes on, probate, the collection of her belongings, burial, etc...

Will my mom be able to use family leave time for these things?

Thanks

Re: Family Leave Specifics

Unfortunately, bereavement leave is not part of CFRA/FMLA leave. So check the company's polcies on that subject. I don't know that I completely answered your question because I don't understand how the hmo plays into this problem.
