Legal Question in Medical Leave in California

Family Medical Leave Act

I understand that under FMLA I may take off 12 wks. However, my daughter was born 3.5 wks early. I heard somewhere that I could take that much extra amount of time off due to her premature birth, up to 16 wks. Is that true? If so, does my company still have to pay my health insurance, or do I?

Re: Family Medical Leave Act

There are two types of leave associated with pregnancy, pregnancy disability leave lasting up to four months and is for health problems related to childbirth and 12 week FMLA leave for bonding. These leaves run consecutively. So it depends on how long your doctor ruled you were disabled by pregnancy as to how much FMLA time you have left.
