FMLA - intermittent retaliation? harassment?
I was on intermittent FMLA leave (working a part time schedule) to care for my father. I was supposed to return to work on January 28, 2008 full-time. Prior to that date I confirmed with my manager that I would be able to resume work full time on Jan 28. HR wouldn't let me return to work until I provided a ''return to work'' form from my father's DR, which I had done at the onset on my FMLA. The DR provided the same form (again) and they said it wasn't good enough and I couldn't return to work full-time until they got a ''return to work'' form. I was harassed constantly for this form until I submitted my resignation. Found out later the form doesn't exist. Could I be eiligible for back pay or at least a harassment/retaliation claim?
