Legal Question in Medical Leave in California
Fmla
I was on FMLA and my job tried to
terminate me. My union has been
doing everything possible to rectify
the harassment. It is at the point
that I am only dealing with the HR
director and the union president. I
already filed a report with DFEH
and I am awainting for the
outcome on that. I recently
changed departments and sites. I
wanted to use CFRA and I used
two days worth. My new
supervisor wrote me up on the first
day of the job for using
CFRA/FMLA. How can I excersize
my rights. I feel as if I don't have
anything left in me to fight.

Re: Fmla
For best results, consider talking to an employment attorney. More facts are needed to formulate an informed opinion than what you have provided here. Upon review of your case, an employment attorney may decide to take it on a contingency basis (meaning you do not pay unless the attorney recovers monetary damages for you), inform DFEH, and get an immediate 'right to sue' letter. Feel free to contact our office if you are serious about getting help.
