Legal Question in Medical Leave in California

Pregnancy Leave

I've been at my job only 5 months. I am 6 weeks pregnant and would like to know if I qualify for any type of family leave. The HR rep here told me that I don't qualify for anything.

One of the criteria to be qualified for family leave is that you must be employed with the company for a least one year. However, if the California employer has at least 5 employees, including you, you are eligible for up to 4 months off for maternity leave. Check with the HR person again and ask her to explain why you cannot take maternity leave under the Fair Employment and Housing Act. If you believe you are getting the run around, contact a local attorney who specializes in employment law.
