Legal Question in Medical Leave in California

Terminated while on baby bonding leave

My husband submitted all the proper forms to his HR department to go on CFRA (baby bonding) leave but apparently HR never received it. We have the fax confirmations to prove it. As a result he was terminated for job abondonment, even though we have phone records showing that he called his manager while on leave. He never received a call or any letters from the company prior to the termination. What legal action can we take?

You can file suit over that. . . You should send the company a certified letter now with the fax receipts and phone records and a statement of the facts -- it should be copied to all of the high level managers that are in the chain of command - you should also look at the personnel handbook or rules to determine what it says about appealing the termination. I suggest you and your husband consult with two or three experienced employment law attorneys, in the County you live in, to assess the facts of your case, discuss your options and strategies and retain the attorney you feel most comfortable with.
