how do i get a theft incident removed from my backround if it was 2 years ago, i paid it off, and it never went to court?? An employer went to do my backround check and it was on there from Mervyns....

You don't have a criminal record, but -- as many people don't realize -- there's a privately maintained database of alleged thieves. You need to request a copy of the "background check" from the prospective employer under the Fair Credit Reporting Act. This will involve writing letters, certified mail return receipt requested.
