Legal Question in Civil Litigation in California
I had my 4 mo. old kitten spayed at a low cost clinic, it cost $45. 5 days later cat was looking like she was going to die, so we took her to a Vet and they informed us that they get alot of animals with complications from that clinic. Vet gave my kitten treatment (Antibiotics, Anti- inflammatory and pain medication) total cost was $129. Now 3 days later my kitten starts being lethargic again, so I took her back to the Vet again. More treatment for Resperatory Distress (Oxygen) and more pain medication at the cost of $56.00. Total cost for the procedure and now the complication due to this low cost spay has now cost me almost $300 & kitten may not survive. What legal right do I have in this situation and can I sue the low cost clinic for malpractice under these circumstances? Or at least recoup expenses incurred?

If you can get the vet to say it was malpractice, you have a good case for recovery of all your costs and expenses in small claims court.
