Legal Question in Civil Litigation in California

My 8 year daughter was pepper sprayed at school the school took 28mins to contact me also I signed a consent to treat her in case of emergency an no emergency response team was contacted therefore my child was not able to recieve treatment till about 1hour after the pepper spray exposure how do I go about getting my daughter restitution
