Legal Question in Civil Litigation in California

18 year old drivers and underage passengers

Our 18 year old son, who is on our auto insurance, insists on driving his 15 year female friend around without her parent's informed consent. Does this create a higher liability risk than driving his over 18 year old friends?

Re: 18 year old drivers and underage passengers

Your auto insurance only becomes relevant if there is an accident, and then it pays only for injuries and property damage. If the 15-year-old is injured, her injuries will not be more severe merely because her parents don't approve.

But if your son's "friend" is his girlfriend, and what you call acting "without her parent's informed consent" is actually defiance of their instructions, then you may have other legal issues to worry about.

As to the risk presented by the situation you describe, auto accidents are the least of your problems.
