Legal Question in Civil Litigation in California
I accidentally used my roommate's checkbook to make a payment (I sign my name on it as well and neither of us notice that). Then check was return for insufficient fund, I have paid the bank fee back to my roommate. Can my roommate charge me for fraud?

You can get into all sorts of trouble, both civilly and criminally, if you used your roommate's check on purpose. Even if this was an innocent mistake, if it looks deliberate you can be sued and/or prosecuted.
