Legal Question in Civil Litigation in California
At age 16 my son was involved in a traffic accident where his vehicle was hit by one car and pushed his vehicle into a third party. The third party sued him in small claims court when he was 17. A judge ruled in the other party's favor and a lien was placed against my son. He is now trying to purchase his first home and the lien is creating problems. In California, can a lien be placed against a minor? It has since been 7 years. Is there a time limit that this can be on his credit report? The rest of the credit report is A+.

In California a judgment is valid for 10 years and can be renewed every 10 years indefinitely. Anyone having a judgment against another person is entitled to record an Abstract of Judgment which will remain a lien on real property, whether acquired before or after the date of the judgment, for the term of the judgment and can be renewed at the same time as the judgment.
Why did you not tender the claim to your automobile insurance carrier?
The quickest way to clear the lien is to pay the judgment, get a satisfaction of judgment form and record it.
