I have a agreement that says that this person has to remove his stuff from the yard can I throw it in the street when he does not take it .

No. You have to follow the terms of the agreement. If he breaches the terms of the agreement, their are legal procedures for disposing of personal property stored on someone's property under an agreement. Throwing it in the street is immature, and if I were your neighbor, I'd report you for littering.
