Legal Question in Civil Litigation in California

altered exhibit

this is a limited civil case in which the plantiff has altered one of his main exhibits to reflect that I am liable. Under what rule, law and/or case can I have that exhibit thrown out?

You need to retain a document expert to analyze the document and opine that is has been altered!

Re: altered exhibit

Whether the document is genuine is a factual question which the jury will have to decide. You can't have it "thrown out" but you can try to show the jury that the plaintiff has offered an altered document as if it were genuine. If you can prove this then the jury will disregard the modification and will likely be very skeptical of the plaintiff's testimony and other evidence.
