Legal Question in Civil Litigation in California

I had an american express credit card which was jointed with my ex boyfriend and now that we are no longer together he refuses to pay. Moreover, he threatened me that he would kill me and anyone I would date after him. Can I sue him and would it have to be in a small claims court? Also, does it matter that he is undocumented?

If he is threatening to kill you or anyone you date, you should be concerned about you safety. You should notify the police about his threats, and consider obtaining a domestic violence restraining order. Suing him for the unpaid credit card charges could enrage him and increase your risk of harm. Suing him in small claims court is possible, the maximum amount is up to $10,000.
