Legal Question in Civil Litigation in California

Aparatment (Put security Deposit for) not available

We were going to move to another apartment on 15th of this month and on 7th we were notified that the we cannot move-in, because current tenant living there can't move out. We went to see manager, and she offered us another apt. in another building, but we were interested in one, we put security deposit for, because our relative lives there, so we were ready to move-in what she offered us temporarily and wanted to move back to one we supposed to get and she got mad on us, told us to leave and said that she did want to deal with us people and showed us to the door.

Place we currently live can't extend our stay, and said if we stay against their will, they will evict us. We only have five days to find another place, otherwise we will be homeless with 8-month old baby. Please advice. Appericate your help in advance.

Re: Aparatment (Put security Deposit for) not available

You may have a case against the new landlord for breach

of contract, which may cover your damages (extra costs) or

having to live somewhere temporarily, and for the

additional rent of a new place over the rent of the one

you had put the deposit for.

Nothing is going to help you within the time frame you suggest.

You have to deal with the situation as the law won't move that

fast at all.
