Auto Shop Error Costs me 1000$+

Recently I was involved in a one car accident escaping a swerving car. I called 5 different body shops about my car, and asked them all very plainly if they could handle my car because it is a limited edition model and has very special parts. 4 of the body shops said they didn't feel comfortable and one said they had a very knowledgable VW person etc... The body shop submitted my VIN# and the parts request to the VW dealership and one of the parts ended up being backordered 4 weeks all the while I'm paying for a rent-a-car. 4 weeks later the part comes in and the VW people had ordered the wrong part. The body shop is refusing to give me a courtesy car now that someone has made an error claiming it's not their fault. From my understanding I can't sue the VW people, because my contact was with the body shop. I've been told that I must sue the body shop and they would have to sue the VW dealership. During this 4 week time I have been so broke that I have had no life, I've been eating ramen noodles, and mostly drinking water. I relied on the expertise of these people to my detriment of over 1000$ at this point, and I feel like I deserve some compensation. Do I have a case, and if so who do I have to file a claim against?

Depending on the circumstances of the accident. If there is insurance available, you should try to claim some of your damages there (the loss of use or rental should be submitted to the insurance carrier of the responsible party).

As for who to sue for the damages, your damages are mostly coming from the rental so insurance is the best way to go. If you really want to sue, you should find out the responsible party and file in small claims.
