Legal Question in Civil Litigation in California
I bought a California house equipped with 24/7 security provided by the former owner's contract- which has 24 months remaining. I've refused to continue paying the remainder of the contract as I don't want this kind of service installed & operating in my home. System is on. I have no input to its functioning. I called the alarm company to ask them to turn it off. The replied it is under a contract & if I turned it off, it would trigger an alarm with a deputy sheriff responding. What are my options in removing this security system?

Their contract is not with you - it is with the prior owner, unless you somehow became obligated since you moved in. Making payments could be enough to hold you responsible under the agreement. As for them turning it off and triggering an alarm, I seriously doubt that would happen. They are just trying to bully you into keeping it. If they were right, then there would be alarms going off everywhere all the time. Call their bluff. Or take the agreement to a local attorney for review.
You could also contact the dpt of consumer affairs. Alarm companies are required to be licensed. This conduct could be a violation of their license. http://www.bsis.ca.gov/consumers/index.shtml
