Legal Question in Civil Litigation in California

I bought a dog that was 10 months old. I took it to the vet the next day and the vet said the dog was malnurished and under wight, terrible plaque and tarter on his teeth, a deformed rib bone, and his knees are popping. I took it to another vet the day after that and she said the same thing. She even estimated the dog was 3-4 years old. When I contacted him he said his other breeders must have switched the dogs on him. He apoligized. I told him I would like my money back and he says he does not do refunds, but will exchange for another similar dog. Ultimatly my question is, am I stuck with this dog? Do I have grounds to sue to get my money back?
