Legal Question in Civil Litigation in California
I bought used tires from a reputable used tire dealer. Three weeks to the day after putting them on my vehicle, one of the tires blew, causing an accident that nearly destroyed my vehicle and damaging another. Luckily, no one was injured, but it could have been very tragic. Upon reviewing the blown tire, I discovered that he put a 20 yr old tire on my vehicle. The other three tires were much newer. The old tire looked great on the outside, but it was a time bomb waiting to go off and he put that on my vehicle and allowed me to drive out in traffic. Does he have any liability for this and am I entitled to any compensation for damages. Unfortunately, I had dropped full coverage on my vehicle in May and now have only liability. Not sure what area of law this would fall in but it seems to me he should bear some responsibility for putting that time bomb on my car and almost killing me and several other people.

Hang on to the tire. Fortunately no one was injured and therefore, perhaps unfortunately, you would be entitled to sue the tire dealer for property damage only. Watch out for legal time limits.
