Legal Question in Civil Litigation in California

Boyfriend moves out.

My boyfriend lived in my house 9 years and just moved out. He was near bankrupt. I let him move in to avoid bankruptcy. Not willingly I let him take second out on my house so he could pay off all his bills and have the one payment. I asked for rent - I knew his situation improved. He never did. He got a low int. loan and paid off other. In February he received a big severance package. I got nothing - been asking him for rent money. My house needs work. Found out he has a PO box since Feb. He informed me he was paying off loan and moving out - he already had a place rented. The last 4-5 years I did get him to pay some utilities.

Can I get any back rent from him? I paid over 90% of groc. & everything first 4 yrs.

I am unemployed now. I feel used & hurt. I still care for him. I do need the money.

Do you have any kind of written agreement? A verbal agreement is legally binding if you don't. Does he have a job or any source of income that you could place a lien on if you received a judgment against him? The reason I am asking is even if you sued him and received a judgment for back rent would you be able to collect? I doubt that he would simply write you a check for what he owes. Additionally, unless you can prove fraud he can file for bankruptcy and discharge the judgment. If he has a job or any assets then you may be able to get your money out of him.
