Legal Question in Civil Litigation in California

Breach of contract?

purchased a used vehicle from private dealership on my contract it stats an incorrect VIN number and number of cyclinders stats V8 and was told by salesman at the time of purchase this also but just found out its an V6. I also purchased an extended warranty for $1,500.00 that was included in my financing but was informed this was never valid due to this vehicle being altered by dealership Im I entitled to that money back? This vehicles frame has broke twice already and is currently not driveable. I am unable to make $400 payments to something that is just sitting in my garage due to this finance company wants to reposses it, if so what rights do I have after that?

Re: Breach of contract?

It sounds like you have a claim pursuant to the consumer legal remedies act of California and the unfair and deceptive business practice law. If the seller arranged the financing, you may also have a claim against the finance company. Please call me at my office to discuss (818 597-2610) or send an email. Thank you, Howard Silver
