Legal Question in Civil Litigation in California

Breech of verbal contract

I am being sued by a former live-in partner who is claiming breech of contract. The alleged contract is stated as being a verbal contract for me to provide support for her for a one year period, and at the end of that one year period to provide a new automobile for her teenage daughter. These conditions were not promised verbally or in writing, and this is a case of my word against hers. I have loaned her money for a short period of time after she moved out, and she is using these loans as a basis for her case. She is representing herself, and my attorney seems to be content to let her run the show at her own pace. I need this resolved now! I'm already out $7,500. What can I do?

Re: Breech of verbal contract

Unfortunately, these kinds of cases are becoming rather common. The only ways to deal with this are either through settlement (mediation) or taking it to trial. If the money she claims is owed is in exchange for sex, it would be an illegal agreement. I'm sure that's what your attorney would argue. Your attorney should take her deposition and determine the basis of your supposed promise to her. That means more $$ on your part, though. Good luck!
