Legal Question in Civil Litigation in California

Broke and need to sue

My ex-girlfriend of 9 years threw me out of our rented house and will not give me my personal things. Personal things like items of my deceased mothers' and things my mother gave me. I don't even care about an entire house full of things we bought together but she has threatened to sell or throw out my mothers' things and I am currently on un-employment. Can I waive the filing fees to sue her for my personal items?

Please help me.

The fastest and cheapest way for you to get your stuff back would be through a forcible entry and detainer filing. It is questionable whether you would prevail in such a lawsuit, but you probably would be able to get her to agree to give you your stuff in return for droppong the lawsuit. Also, a firm letter from me might scare her enough to give in. Otherwise, you can sue for money in small claims where the filing fee is ususally less than $30.
