Legal Question in Civil Litigation in California

to help my brother get a car I agreed to be the first on the loan and he is the cosigner. He is supposed to make the payments and he is always late, he rarely keeps insurance and my wages were nearly taken because he didnt pay the registration. I want to take the car back and go sell it to pay it off and be done with it. How would I go about taking the car back? if he refuses to give it to me freely?

If he is on the title as the sole owner, unless he signs the car over to you you will have to go to court and prove that you are entitled to the car. From what you say, it seems like you would only be entitled to a money judgment. In that case you would have to then try and enforce your judgment against the car. The best solution is to try and work it out with him.
