Business Interuption Claim Steming from an Auto Accident
My business lost over $25,000 when an accident occured on a local freeway. The Police moved one of the vehicle's invovled off the freeway and on to the surface street where my business is. The vehicle was a big rig leaking chemicals. The street was closed off for half a day causing me loss of business and lost wages to my employees. Is the driver of the vehicle(and his insurance company) which caused the loss on the freeway responsible for my business interuption claim? They seem to believe they are not!

The police or the driver may be liable for your loss, but I would need more information. Do you have business interruption insurance? I am handling a similar claim by a business that suffered for several weeks while the city repaired a 20 foot sinkhole in front of the business. Given the amount of the claim, you should contact an attorney. In addition, there are strict time limits and you need to move quickly to preserve your rights.

This is a tricky situation. Depending on the type of insurance the driver of the vehicle which caused the accident had and if the police could be held responsible because the placed the vehicle in front of your store, you might be able to file a claim for damages against either or both.
